
Littlejohn v. School Board of Leon County
This amicus brief filed by the States of Florida, Montana, 17 other states, and the Arizona Legislature in the case of Littlejohn v. School Board of Leon County supports the our petition on behalf of Jeff and January Littlejohn for an en banc rehearing in the Eleventh Circuit Court of Appeals. The 19-state brief argues that the panel's decision, which found that the school board's policy of concealing a student's social transition from parents did not "shock the conscience" under the substantive due process clause, undermines fundamental parental rights. Highlighting the deliberate nature of the school's actions and the historical recognition of parental authority over their children, the amici assert that the school's conduct violates deeply rooted liberty interests. They urge the court to grant a rehearing to address this critical issue and align the ruling with Supreme Court precedent.
